3. Access to Password Protected/Secure Areas

Access to and use of password protected and/or secure areas of the website is restricted to authorised users only. Unauthorised individuals attempting to access these areas of the website may be subject to prosecution.

When you visit our website or send e-mails to us, you are communicating with us electronically. We communicate with you by e-mail or by posting notices on the website. For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

5. Registration

Thornton Hall reserves the right to close accounts if any user is seen to be using proxy IPs (Internet Protocol addresses) in order to attempt to hide the use of multiple accounts or disrupts any of our services in any way.

If you use multiple logins for the purpose of disrupting the community you may have action taken against all of your accounts.

6. Terms of Sale

By placing an order you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.

Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are limited to mainland UK and subject to any delays resulting from postal delays or force majeure for which we will not be responsible.

In order to contract with Thornton Hall you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us. Thornton Hall retains the right to refuse any request made by you. If your order is accepted we will inform you by email and we will confirm the identity of the party which you have contracted with. This will usually be Thornton Hall or may in some cases be a third party. Where a contract is made with a third party Thornton Hall is not acting as either agent or principal and the contract is made between yourself and that third party and will be subject to the terms of sale which they supply you. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods. The cost of foreign products and services may fluctuate. All prices advertised are subject to such changes.

6.a. Our Contract

When you place an order, you will receive an acknowledgement e-mail confirming receipt and payment of your order.

6.b. Pricing

All prices are in GBP UK Pounds and include the UK applicable VAT. They exclude shipping and handling costs and duties unless otherwise stated. The total price stated on the order form you submit shall be the total amount payable by you for the products including all taxes, duties, handling and shipping charges.

If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund. VAT is not included in our prices for customers outside of the EU. Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the 'Total Cost'.

Delivery costs, where applicable, are payable by you as indicated on your invoice.

6.c. Payment

You must pay in the currency as indicated on your invoice.

If you are paying by credit card, then you must supply your credit card details when you place your Order. Your credit card will be charged when we issue your invoice or on the moment of shipment of your Products. Thornton Hall will not supply the Products to you nor perform the services until your credit card issuer has authorised the use of your card for payment of the Products and/or services ordered. If Thornton Hall does not receive such authorisation Thornton Hall shall inform you accordingly. Thornton Hall reserves the right to verify the identity of the credit card holder by requesting appropriate documentation.

Incorrect Items

In the unlikely event that you receive goods which were not what you ordered, please Contact Us immediately.

Damaged Items

When your goods are delivered, please check that the order is complete and not damaged. In the event that your order is visibly damaged, please do not accept the order and enter on the delivery note “Damaged” along with a brief description of how or where the item is damaged.

If the damage is found after opening the Goods, please Contact Us on the day the item is received, no later, with details of the damage. This will help us considerably in raising the matter with our appointed courier. Once the damaged goods have been received back into our warehouse, checked and verified to be damaged, we will send out a new replacement.

Please note that for courier companies to accept liability for damage caused in transit we must inform them of any damage within 24 hours of delivery. Therefore, please inform us as soon as possible following delivery of the Goods. Any claims made after this time but within 3 days will be subject to our discretion and thereafter any such claims may be considered unreasonable.

8. Limitation of Liability

In no event shall Thornton Hall, its affiliates, partners, licensors or suppliers be liable for any indirect, consequential, punitive, special or incidental or other damages resulting from, arising out of or in connection with the access, use of, or inability to access or use this web site, the content or the user content, even if Thornton Hall has been advised of the possibility of such damages except to the extent such damages arise as a result of fraud or fraudulent misrepresentation on the part of Thornton Hall.

Save as set out in the paragraph below, there are no warranties, conditions or other terms that are binding on Thornton Hall regarding the supply of Products or the provision of Services except as expressly stated in the contract.

Any warranty, condition or other term arising out of or in connection with the supply of Products and/or the provision of Services which might otherwise be implied into or incorporated in the contract by statute, common law, laws applicable in the country where you purchased the Products or Services or otherwise (including without limitation any implied term as to quality, fitness for purpose, reasonable care and skill) is hereby expressly excluded to the maximum extent permitted by law. In particular, Thornton Hall will not be responsible for ensuring that the Products are suitable for your purposes.

Nothing in the contract shall limit or exclude our liability (i) for death or personal injury caused by our negligence or (ii) for fraud or (iii) any breach of the obligations implied by applicable compulsory national laws as to title or (iv) any liability which cannot be excluded by law.

Thornton Hall will not be liable under the contract for any loss of income, loss of profits, loss of contracts, loss of data or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise. Thornton Hall maximum aggregate liability under the contract whether in tort (including negligence) or otherwise shall in no circumstances exceed the amount payable by you to Thornton Hall in respect of the product(s) and/or services in question.

This does not affect your statutory rights as a consumer.
